These terms and conditions (‘the Terms’) govern the users (‘you’ or ‘your’), use of www.thehistorypress.co.uk (‘the website’) and any other related products and services (‘goods’) that refer or link to these Terms (collectively, the ‘Services’) and your relationship with The History Press Limited whose registered address is 97 St George’s Place, Cheltenham, Gloucestershire, GL50 3QB. (1) Introduction

These terms and conditions govern your use of our website; by using our website to browse or buy a product, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, then you are expressly prohibited from using the website and Services and you MUST DISCONTINUE USE IMMEDIATELY.

(2) Intellectual property rights

Unless otherwise stated, we or our licensors own the intellectual property rights in the website, material on the website and our Services.  Subject to the licence below, all these intellectual property rights are reserved.

(3) Licence to use website           

You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions below.

You must not:

(a) republish material from this website (including republication on another website);

(b) sell, rent or otherwise sub-license material on the website;

(c) reproduce, duplicate, copy or otherwise exploit material on our website for a commercial purpose;

(4) Limitations of liability

The information on this website is provided free-of-charge, and you acknowledge that it would be unreasonable to hold us liable in respect of this website and the information on this website.

Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we commit to ensuring that the website remains available or that the material on the website is kept up-to-date.

To the maximum extent permitted by applicable law we exclude all representations, warranties and conditions (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill).

Our liability is limited and excluded to the maximum extent permitted under applicable law.  We will not be liable for any direct or indirect loss or damage arising under these terms and conditions or in connection with our website, whether arising in tort, contract, or otherwise.  Without limiting the generality of the foregoing exclusion, we will not be liable for any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings arising under terms and conditions or in connection with our website, whether direct or indirect, and whether arising in tort, contract, or otherwise.

However, nothing in these terms and conditions shall exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law.

This website contains links to websites that are owned and operated by third parties. The History Press Limited has no control over these sites, and can accept no responsibility for their content. Links are provided in good faith and are included solely for the convenience of users. Links do not constitute an endorsement of external sites.

(6) Restricted access

We reserve the right to restrict access to areas of our website, or indeed our whole website, at our discretion.

(7) User representations

By using our website and Services, you represent and warrant that:

(a) all registration information you submit will be true, accurate, current and complete;

(b) you will maintain the accuracy of such information and promptly update such registration information as necessary;

(c) you have the legal capacity and you agree to comply with these Terms;

(d) you will not access the website or Services through automated or non-human means, whether through a bot, script or otherwise;

(e) you will not use the website or Services for an illegal or unauthorised purpose;

(f) your use of the website or Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the website or Services (or any portion thereof).

If you require a user ID and password to enable you to access restricted areas of our website or other content or Services, you must ensure that that user ID and password is kept confidential.  You accept responsibility for all activities that occur under your user ID or password.

We reserve the right to remove, reclaim or change a username you select if we determine, in our sole discretion, that such a username is inappropriate, obscene, or otherwise objectionable.

We may revise these terms and conditions from time-to-time. Please check this page regularly to ensure you are familiar with the current version.

(10) Entire agreement

These terms and conditions constitute the entire agreement between you and us in relation to your use of our website and Services, and supersede all previous agreements in respect of your use of this website.

(11) Law and jurisdiction

All contracts under these Terms shall be governed by and construed in accordance with the Laws of England and all disputes shall be submitted to the non exclusive jurisdiction of the English Courts.

(12) Orders

Orders on our website fall into two categories:

a) Direct orders – fulfilled by The History Press Limited.

b) Orders via third party retailers – fulfilled by your selected third party retailer (Amazon.co.uk, Bookshop.org, Waterstones, Glassboxx)

(12a) Direct orders

All direct orders are subject to acceptance and availability.

Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the website(s). The conclusion of a contract between you and us will take place when a delivery attempt has been made to the address(s) you have specified and payment has been received.

You will assume the risk for the goods once they have been delivered to the delivery address which you specified. We accept no liability if you provide an incorrect delivery address.

If we are unable to fulfil your order, or reject your order for whatever reason, a refund for the full amount will be credited to you.

(12b) Orders via third party retailers

Contracts for the supply of goods referred onwards through our site or as a result of visits made by you are governed by the terms and conditions of sale of your selected third party retailer.

(13) Refunds

As a small independent we are not able to issue refunds on direct orders unless a book is damaged or faulty at point of purchase.

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right. If your purchase is faulty we ask that you email a picture of the damaged book to salessupport@thehistorypress.co.uk within 30 days. If your return is accepted, we will provide details regarding how to return your goods free of charge, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.  

We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund too.

Notification of damages or non-delivery must be made in writing to The History Press Limited within 14 days of the due delivery date.

Returns of goods ordered via a third party retailer are governed by the terms and conditions of sale of your selected retailer.

(13a) Exceptions

The following items cannot be returned:

Payment may be made by Visa/MasterCard or American Express and should be made with an order.

Any discounts agreed on an order will apply only to amounts paid in accordance with the agreed Terms.

Title to goods remains with The History Press Limited until all sums due are paid in full.

Orders with a delivery address outside the UK may be subject to opening and inspection by local customs authorities. In respect of such orders the recipient is deemed to be the importer of the goods and must therefore comply with all the laws and regulations of the country into which the goods are being delivered and be subject to import duties and taxes.

You confirm that you are authorised to use the payment method you select. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card does not authorise payment to us we will not be liable to you for any delay or non-delivery.

You may only use one discount code with each order. We allow you to use discount codes strictly on the terms and conditions upon which they were issued which, amongst other things, may include terms relating to your eligibility to use them and a maximum order value.

All generic promotions (promotions which include more than one title) clearly state how long the offer applies.

The History Press Limited reserves the right to amend or withdraw any promotion or offer at any time without prior notice. All promotions and offers are only available while stocks last.

(15) Eligibility to Purchase

To be eligible to purchase goods on the website(s) and lawfully enter into and form contracts with The History Press Limited under English law you must:

(a) if an individual, be 18 years of age or over; and

(b) register your real name, address, phone number, e-mail address and any other details requested.

By offering to purchase goods and services you authorise us to transmit information (including updated information), and to obtain information from third parties, including but not limited to, administrators of the payment method selected.

It is a criminal offence to purchase or attempt to purchase goods with a stolen credit card, or with stolen personal details, or with a false name. We will take appropriate action if we discover any person is attempting to fraudulently purchase goods from our website.

We reserve the right to withhold goods and terminate any account details with anybody whom we suspect of fraudulent practice and / or breach of these terms and conditions.

(16) Delivery

Notification of damages or non-delivery must be made in writing to The History Press Limited within 14 days of the due delivery date. We will not accept claims for compensation or refunds after this period.
